Bail is when you make a promise to the Court to appear on future dates when your case is listed for hearing. You may also promise to adhere to other conditions imposed by the court. When charged with a criminal offence, you might not be granted bail on the spot by the police. For serious offences, you may need to lodge a separate bail application.

Once a bail application has been made, it will usually be up to a magistrate or Judge to make a decision whether or not the request should be granted bail. Because criminal trials can go on for months or even years, making a successful bail application can be extremely important to the person facing charges.

If you make an unsuccessful bail application, the current laws make it extremely difficult to have a second bail application unless you go to the Supreme Court. Therefore it is very important that you don’t lose your chance to get bail.
