When a driver commits 3 major offences within a 5 year period the RTA will impose a 5 year disqualification period in addition to any period of disqualification that a court may wish to impose. When combined with suspensions imposed by the magistrate, the total disqualification period that such an individual faces becomes very lengthy indeed and can on occasion span to a decade or more.

However, Habitual Traffic Offender Declarations can be quashed by a magistrate on appeal. Such an appeal should be filed towards the end of the court-ordered disqualification period. It can be very helpful if a person can show the magistrate that they have gone for an extended period of time without committing further offences. In these circumstances, magistrates will often look favourably upon such an application, meaning that the individual concerned can be back on the road years earlier than had been anticipated.

We have a very good track record in getting Habitual Offender Declarations quashed. In fact, we will represent you on a NO WIN NO FEE basis. If you don't win the case and get back on the road sooner, you won't have to pay our fees.

In addition, we offer HOME VISITS at no charge to clients who have difficulty traveling and/or finding public transport in situations where they live in remote locations or are in poor health.

We will also advise on what steps are necessary to best prepare the case before Court (organizing character references, attendance at a Traffic Offenders Program etc) and represent you in Court on the day of the hearing.

Often getting an Habitual Offender Declaration quashed can greatly assist an individual in improving their personal situation. Getting your drivers licence back can mean getting a better job or being able to start a business.
